Disclaimer and Limitation of Liability

Our software is free and provided as it is. The realistic risk is not that DAWN breaks your computer — it is that it changes something in a session you had not saved. Back up your work. If you are a consumer, the Consumer Rights Act 2015 gives you rights that nothing here removes.

01No warranty

DAWN and MeterStack are provided as they are and as available, without warranty of any kind. To the fullest extent the law allows, we exclude all implied terms, including satisfactory quality, fitness for a particular purpose, and non-infringement.

In particular we do not warrant that:

  • the software will be uninterrupted, timely, secure, or error-free;
  • defects will be corrected, or corrected within any period;
  • it will work with any particular version of macOS, Ableton Live, or any third-party plugin;
  • its output will be accurate, complete, musically appropriate, or fit for what you intend;
  • measurements shown by MeterStack are correct for a given delivery specification;
  • it will remain available at all. The DAWN beta expires on 30 September 2026.

02Data loss is the real risk

Back up your work

DAWN makes changes to your live session. That is the whole point of it. It is also the single most likely way it can cost you something.

We want to be specific rather than hide behind general wording. Things that can realistically happen:

  • The agent misinterprets what you asked and changes something you wanted left alone.
  • A change cannot be undone, because the DAW does not support reversing it.
  • An action leaves a session in a state you did not intend, and you notice later.
  • With Mac control active, the agent operates an application outside your DAW and something there is altered.
  • A crash loses unsaved work, as any software crash can.

DAWN keeps a redacted audit record of what it changed, confirms before high-risk actions, and can reverse actions where the DAW supports reversal. These reduce the risk. They do not eliminate it, and we are not going to suggest they do.

You are responsible for keeping backups. Save versions of anything you care about before letting an agent work on it. This is ordinary practice for consequential work, and it is the one precaution that reliably prevents the problem.

03Third parties we do not control

DAWN depends on services and software from others. We are not responsible for:

  • Your AI provider — availability, output quality, pricing, rate limits, model changes, outages, or account suspension. They may withdraw a model at any time and DAWN will stop being able to use it.
  • Charges you incur with a provider. Agent use can be expensive, we receive none of it, and we cannot cap or refund it.
  • Ableton, Apple, or any plugin vendor — an update to any of them can break DAWN’s behaviour without notice.
  • Optional local add-ons such as ACE-Step or Whisper, which are separate software under their own licences.
  • Anything you reach through DAWN’s web access, including the content and accuracy of pages it reads.

04AI output

We make no representation that anything DAWN produces is accurate, original, non-infringing, or suitable for release. AI models produce plausible output, which is not the same as correct output, and generated audio can resemble existing work without warning.

You are responsible for checking what you release. This is covered properly in the AI Use and Output Notice.

05Limitation of liability

To the fullest extent permitted by law, we are not liable for:

  • indirect, special, or consequential loss;
  • lost profits, revenue, business, or anticipated savings;
  • lost, corrupted, or altered projects, recordings, or other data;
  • lost studio time, missed deadlines, or damage to reputation;
  • charges incurred with any AI provider;
  • anything arising from your use of, or inability to use, our software.

Where we are liable, our total aggregate liability for all claims is limited to the greater of what you paid us in the twelve months before the claim — currently nil, as our products are free — or £100.

These limits apply regardless of how a claim is framed, whether in contract, tort including negligence, or otherwise.

06What we do not exclude

Nothing in this document, or in any of our other terms, excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • anything else that cannot lawfully be excluded or limited.

If you are a consumer

You have statutory rights under the Consumer Rights Act 2015 that these terms do not affect. Digital content supplied to you must be of satisfactory quality, fit for purpose, and as described — and that applies to free digital content too. If our software damages your device or data because we failed to take reasonable care, you may have a remedy under section 46 regardless of the limits above. Where anything here conflicts with your statutory rights, your statutory rights prevail.

07If you are a business user

If you use our software for business purposes, the exclusions and limits above apply in full to the extent permitted by the Unfair Contract Terms Act 1977. You accept that a free product carries the risks described here, and you are responsible for assessing whether it is suitable for your work before relying on it.

If you are running a facility or working for clients, consider the Acceptable Use Policy on whose machines DAWN may be installed.
